1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use. This license is consistent with Apple's Licensed Application End User License Agreement (EULA) where applicable.

All rights not expressly granted to you are reserved by us. You may not sublicense, sell, resell, transfer, assign, distribute, or otherwise exploit the App or any part of it.

2. Apple App Store and Google Play — Additional Terms

If you obtained the App through Apple's App Store, the following applies in addition to these Terms:

• These Terms are concluded between you and us, not with Apple Inc. Apple is not responsible for the App or its content.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• In the event of a third-party intellectual property infringement claim, Apple will not be responsible for the investigation, defense, settlement, or discharge of such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you obtained the App through Google Play, Google's Terms of Service also apply to your use of the Play Store.

3. Permitted Use

You may use the App to:

• Download and run AI language models on your personal device for offline text generation
• Download and search offline wiki packs stored on your device
• Access your device's sensors (compass, GPS, barometer, etc.) for personal field use
• Manage downloaded model and wiki pack assets on your device

4. Prohibited Use

You may not use the App or Website to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Redistribute, sell, resell, or sublicense the App or any downloaded content
• Use the App for any unlawful purpose or in violation of any local, national, or international law
• Generate content that is illegal, defamatory, harassing, abusive, fraudulent, or otherwise harmful
• Use the App to develop competing products or services
• Attempt to interfere with or disrupt the integrity or performance of the App or our download infrastructure
• Use automated tools to scrape or download content from our catalog infrastructure

5. AI-Generated Content — Important Disclaimer

You acknowledge and agree that:

• No professional advice. Content generated by the App does not constitute medical, legal, financial, safety, survival, or any other form of professional advice. Do not rely on AI-generated responses in emergency situations without verification from authoritative sources.
• No warranty of accuracy. We make no representations or warranties that AI outputs are accurate, complete, current, or suitable for any particular purpose.
• User responsibility. You are solely responsible for evaluating and acting on any information provided by the App. In survival, first aid, or emergency scenarios, always defer to trained professionals, official guidance, and your own judgment.
• Verification required. Always independently verify critical information — particularly regarding food, water, medicine, navigation, and emergency procedures — before acting on it.
• Model limitations. Quantized small language models optimized for mobile devices have significant capability limitations compared to larger cloud-based models.

6. Wiki Content

Wiki packs available in offgridAI are derived from third-party sources (such as Wikipedia and similar projects) distributed under their respective open licenses (e.g., Creative Commons Attribution-ShareAlike). We do not author or verify the accuracy of wiki content. Third-party licenses and attribution requirements are embedded in each wiki pack.

7. AI Model Licenses

AI models available for download through offgridAI are provided by their respective creators under their own licenses (e.g., Meta's Llama community license, Qwen's model license). By downloading a model, you agree to comply with the applicable model license. We provide links to relevant licenses in the model catalog.

8. Intellectual Property

The App, including its design, code, branding, and original content, is owned by Moritz Kiefer and protected by German and international intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license in Section 1.

9. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. As described in our Privacy Policy, all AI processing and sensor data remain on your device.

10. Updates and Changes to the App

We may release updates to the App from time to time. Updates distributed through the App Store or Google Play may be installed automatically depending on your device settings. We reserve the right to modify or discontinue the App or any part of it at any time without notice, though we will make reasonable efforts to notify users of significant changes.

11. Disclaimer of Warranties

The App and Website are provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

To the extent permitted by applicable law, we disclaim all warranties. Some jurisdictions do not allow disclaimer of implied warranties, so the above may not apply to you in full.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Moritz Kiefer be liable for any indirect, incidental, special, consequential, or punitive damages, or damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from these Terms or your use of the App shall not exceed EUR 100 or the amount you paid for the App in the twelve months preceding the claim, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded or limited by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Moritz Kiefer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you generate using the App.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws provisions. If you are a consumer in the EU, you also benefit from any mandatory consumer protection provisions of your country of residence.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection law in your country of residence requires otherwise.

The EU provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. We are not obligated to participate in arbitration proceedings.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date above and provide notice through the App or Website for material changes. Your continued use of the App after such changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the App ceases. Since all data is stored locally on your device, you retain access to your locally stored data.
